ANALISIS HUKUM EKONOMI SYARIAH TERHADAP FASILITAS KREDIT PEMILIKAN MOTOR BAGI KARYAWAN

Abstrak
Penelitian ini menganalisis kesesuaian fasilitas Kredit Pemilikan Motor (KPM) bagi karyawan dengan prinsip hukum ekonomi syariah. Perusahaan menyediakan dana pembelian motor dengan bunga nol persen, memotong angsuran pokok melalui gaji selama 60 bulan, dan menahan Buku Pemilik Kendaraan Bermotor sebagai jaminan. Jumlah pokok yang dikembalikan dipastikan sama persis dengan dana yang diterima tanpa selisih satu rupiah pun, sehingga komponen utama memenuhi karakter qardh tanpa imbalan. Namun, peserta diwajibkan mengikuti asuransi konvensional. Premi dibayar terlebih dahulu oleh perusahaan, kemudian wajib dikembalikan seluruhnya oleh karyawan melalui potongan gaji selama 24 bulan. Walaupun pengembalian premi tidak mengandung tambahan, pembiayaan tersebut tidak mengubah hukum objeknya: karyawan tetap menanggung biaya akad asuransi konvensional yang menurut rujukan penelitian mengandung gharar, maysir, dan riba. Karena KPM merupakan fasilitas pilihan, mekanisme ini menjadi persoalan syariah yang menentukan. Perusahaan disarankan menghapus kewajiban tersebut, menanggung risiko secara internal tanpa menagihkan premi, atau menggantinya dengan skema ta’awuni yang benar-benar sesuai syariah.

Abstract
This study examines the Sharia compliance of an employee motorcycle ownership facility. The employer provides a zero-interest motorcycle loan, collects the principal through payroll deductions over sixty months, and holds the vehicle ownership certificate as collateral. Repayment equals the exact principal received, without even a one-rupiah increment; therefore, the principal facility has the character of a non-remunerated qard. The decisive concern is the compulsory conventional insurance. The employer initially pays the premium, but the employee must reimburse the full amount through payroll deductions over twenty-four months. Although no increment is charged on this premium advance, financing it does not change the nature of the underlying conventional insurance contract, which the selected authorities consider to contain gharar, maysir, and riba. Since participation in KPM is optional, the insurance requirement should be removed, replaced by direct employer risk coverage without employee reimbursement, or substituted with a genuinely Sharia-compliant ta’awuni arrangement.
